Restrictions on free speech can be justified only by the reasons spelt out in Article 19(2),rather than be skinned alive by your Rajya Sabha-ist,how dare you question Rahulji sycophantsit will also win you their respectnot just fear and awe that is more feudal than democratic Then hold genuine elections to the CWC and for general secretaries All this can be done within a montheven before the general election is announced In any caseit is a truism that talent is discovered bottom-up but leadership has to travel top-down Not doing so will be politically suicidal and morally lazy My teacher in strategic studiesProfessor Stephen P Cohenhas always taught us there is no such thing as a good army or a bad army There are only good generals and bad generals And good generals do not blame their armies after losing a battle They put their hands uptake responsibilityintrospect Thats whyfor the Congress to have any hope at allchange has to begin at the very top Congress insiders tell you Rahul always likes to say that only a thousand people decide the names of all MLAs and MPs in Indiaso what kind of a democracy is this Increasingly nowmany have begun to mock this: we know two of them (Sonia and Rahul) Who are the remaining 998 In these state electionswe saw Rahul course correct a bit from the old povertarianism But only a bit More important than the absence of internal democracy is the datedness of the Congress productits fundamental value proposition Why is its oldossified and most loyal vote-bank of the poorDalits and minorities now so breached Because all its promises to them are negative If you are a Muslimwe will protect you from riotsor give you relief if you are a riot victim But what will you do for me if I am an ordinarysecure Muslim dreaming of a better life for myself and my children Do I have to become a riot victim to deserve your healing touch Or if I am a poor Rajasthanido I need to fall sick to deserve your great freebies What if my family and I stay in robust health anyway What will you do to improve my opportunitiesto help me compete on a larger stage And similarlythe poor everywhere: alrightyou give me MGNREGA and free food and I wont starve But what will you do for me thereon And finallyif I am a poor tribalyou may come to help if I am displaced unfairly But what if I am not I just live in extremedegrading and hopeless poverty and want a better life Sixty-five years after Independenceam I permitted to dreamaspire for more than two square mealsessential medicines at lousy sarkari hospitals if I fall sick and maybe physical safety You ask any poor Indian these questionsand she will say she deserves better That is why she is dumping her trusted old Congress If you are aspirationalModi sounds moreand pleasantlypersuasive If you are povertarianthe AAP is most certainly more sincerely convincing So who exactly are you And what do you stand for Congress leaders are not answering these questions Having waited for a decadeits voters are now moving on Not talking to the media is not a nice thing (from our selfishself-important point of view)but it is a public figures choice Maybe journalists are really vermin and must be avoidedand the Congress leaders are not unique in thinking so Many successful regional leaders nowJ JayalalithaaMamata BanerjeeNaveen Patnaik and even Modido not engage with the media in the conventional oldrelaxed manner But each one has found their own way of communicating with their voters What is Rahuls What does one tell a group of college students in sub-rural Rajasthan when they askwhy does Rahul never speak in Parliament And whensimilarlya hall full of IIT students applauds when one of them asks their guest speakerwhat does Rahul Gandhi have to show on his CV besides his DNA And then you make their confusion total by describing democratic power as poison whichI repeatis a feudal constructnot a liberal one YesRahul needs to fix his party in ways we probably cannot imagine But he has to begin by sharing with his ownonce-loyal but now fast desertingvoters what is it that he is imagining He has to establish a conversation with them before he starts whipping his partymen law officer has advised Delhi’s Lieutenant Governor Anil Baijal The legal opinion by the law officer was tendered in response to several queries by the lieutenant governor on whether statements by Kejriwal against Jaitley were in his official capacity and should a special lawyer be provided to the chief minister at the expense of the state exchequer Replying to both the queries in the ‘negative’ Additional Solicitor General (ASG) Sanjay Jain has said the statements made by Kejriwal on his personal Twitter account "have no connection" with his official or public duties and were "distinctly in his individual or personal capacity" File image of Delhi chief minister Arvind Kejriwal Getty Images The ASG in a 14-page opinion has also said that under the Constitution "it is impermissible to use public money for a private purpose" and since Kejriwal was being sued in his individual capacity "public money cannot be used to defend the chief minister for his statements made in his personal capacity" He has advised the lieutenant governor to not approve the proposal for appointment of senior advocate Ram Jethmalani to defend Kejriwal and pay the lawyer out of the government coffers "The position of a chief minister or for that matter as government servant is that of a trustee of public money Public money can spent only in accordance with law and procedures prescribed and must ensure the highest level of financial discipline" the ASG has said Jethmalani (93) has been representing Kejriwal in the civil defamation case filed by Jaitley in the Delhi High Court against the chief minister and five other Aam Aadmi Party leaders over allegations of corruption when the Union minister was the president of the Delhi and District Cricket Association (DDCA) from 2000 to 2013 Jaitley who had denied the allegations levelled by the AAP leaders in December 2015 had filed the suit seeking Rs 10 crore as damages from Kejriwal and the other five claiming they had made "false and defamatory" statements in the case involving DDCA and harmed his reputation According to the suit Kejriwal and other AAP leaders — Raghav Chadha Kumar Vishwas Ashutosh Sanjay Singh and Deepak Bajpai — had accused Jaitley and some of his family members on various fora including the social media of alleged irregularities and financial bungling in the DDCA Jaitley had also lodged a criminal defamation case against them in a subordinate court where the proceedings are on As per the opinion sent to the lieutenant governor on 6 April Kejriwal had "opted to comment upon the affairs of a society (DDCA) and its erstwhile office bearer which is not called upon to be so commented in the ordinary course of his executive or administrative functions" The lieutenant governor had sought the ASG’s opinion after deputy chief minister Manish Sisodia had proposed engaging Jethmalani to defend Kejriwal after the civil and criminal defamation cases were filed against him As per the terms of engaging Jethmalani the veteran criminal lawyer was to be paid a retainer fee of Rs one crore and an appearance fee of Rs 22 lakh per court visit according to the legal opinion This proposal however was objected to by the law and the general administrative departments for not having prior concurrence of the finance department or the lieutenant governor’s approval File image of Union minister Arun Jaitley PTI Sisodia had thereafter issued a standing order (SO) regarding the appointment of special counsel to represent the Delhi government As per the SO the prior concurrence of the finance department and approval of the lieutenant governor was not required for appointment of special counsel and for payment of their fee The lieutenant governor had sought the ASG’s opinion on whether the SO was in compliance of the Transaction of Business Rules (TBR) GNCTD Act and relevant provisions On this Jain has said that the SO had to be approved by the council of ministers and then the lieutenant governor as it would have an effect on the finances of Delhi but this procedure was not followed He has also said that the SO was issued in order "to circumvent the law department observations that prior concurrence of the finance department and approval of the lieutenant governor would be required" for appointing Jethmalani The law officer has further said that as per the file notings placed before him the ministers concerned who sanctioned the appointment of Jethmalani and payment of his fees "have acted in wanton disregard" of the TBR the Delhi High Court verdict holding that the lieutenant governor’s approval was required in administrative decisions and various office memorandums pertaining to appointment of special counsel "The machination of trying to usurp the powers of the finance department and the lieutenant governor clearly show a blatant violation of established norms rules rulings as well as the procedures envisaged under the Constitution of India" the ASG has said He also said the elected (AAP) government "unilaterally proceeded to allow disbursement of public funds for providing fees to Ram Jethmalani without placing the file before the lieutenant governor or obtaining the requisite approval" "In light of the facts and circumstances in my opinion public money cannot be used to appoint special counsel to defend the chief minister for the statements made by him in his personal capacity and the proposal to this effect should not be approved by the lieutenant governor" he has said By: Express Web Desk | New Delhi | Published: April
